Featured Case:
August 11, 2009. The Sanbornton Police charged J.H. with DWI, in a case that included a breath test significantly over the legal limit of .08. On day two of a 
two-day DWI trial in Franklin District Court, under cross-examination by
Attorney Lothstein, the breath test operator admitted he had misplaced critical documentary evidence.

Faced with the spectre of a mistrial, the prosecution dropped the criminal DWI
charge and allowed J.H. to plead guilty to a violation, reckless driving. This
occurred on August 11, 2009 in the middle of the breath test operator's cross-examination. Previously, Attorney Lothstein had won J.H.'s ALS hearing. These hard-fought victories reduced J.H.'s license loss by many months and allowed him
to avoid the stigma and all the costly collateral consequences of a DWI conviction!

Its hard to win DWI cases where there is an incriminating breath or blood test. 
The first question you should ask, however, is: will the lawyer you hire have the experience, expertise and judgment to know when to even try to win?  The only guarantee in the criminal justice system is that you can't avoid a conviction by
pleading guilty.

Ted Lothstein, the only Concord member of the National College of DUI Defense, has spent
over a decade defending DWIs, … and training other lawyers to do a better job defending DWIs. Ted Lothstein has litigated DWI cases in most of southern NH’s district courts, has tried DWIs
and alcohol-related felony jury trials in Superior Court, and has litigated a number of DWI appeals
in the NH Supreme Court, including a landmark victory in April, 2009 that was widely publicized. As a result, the NH Bar Association, of which every NH attorney is a member, selected Ted Lothstein to be the Chairperson, and lecturer on breath and blood testing litigation, for the NH
Bar Association’s first major DWI seminar in the last three years (Dec 3, 2008).  Why is DWI different?  DWI cases involve three unique challenges that, depending on the individual circumstances of your case, may make it foolhardy to retain an inexperienced
lawyer or “general practitioner” who only dabbles in DWI defense:
  • Complex scientific and medical issues;
        
  • Far more “loopholes” or technical defenses based on statutes, administrative
    and constitutional law, than many more serious charges;
       
  • Harsh and never-ending penalties.
    • In NH, even for a driver with no prior record, a DWI prosecution can involve mandatory jail time and the requirement of an "ignition interlock" device, if
      there are aggravating factors such as high BAC, passengers under age
      16 in the car, very high speeds, or an automobile accident that resulted
      in serious bodily injury.
    • All NH DWIs involve lengthy mandatory license revocations, residential
      alcohol and drug abuse programs, steep fines, and endlessly confusing consequences for out-of state license holders.
